General Conditions
- Your order constitutes an offer to purchase products as per the specifications, descriptions, and prices indicated.
- Wherever possible we will accept your order to buy the products of the specification and description at the price indicated by e-mail. Wherever it is not possible to accept your order to buy the products of the specification and description at the price indicated we will advise you by e-mail and offer to sell you the goods of the specification and description at the price stated in the e-mail.
- An order shall be deemed accepted upon written confirmation from both you and us. Until such mutual confirmation is received, the order shall not be binding. Cancellation requests must be submitted in writing and are subject to our written approval. Approved cancellations may incur charges for costs already incurred, including restocking fees or non-recoverable expenses.
- Online orders are finalized after availability is confirmed via email.
Delivery of the Products
- Newtech Limited (hereinafter referred to as “we”/ “our”/ “us”) shall not be bound to deliver the products until full payment has been made, except where written credit terms have been agreed. We may withhold further deliveries if you fail to comply with those terms.
- Payment is due upon the formation of the agreement between you and us.
- Products remain our property until fully paid for.
- Unless expressly stated otherwise, the price of the products does not include delivery costs.
- Deliveries are scheduled based on route planning and stock availability. Orders will be delivered in the next available delivery slot.
- Delivery personnel will wait a maximum of 10 minutes (from on-site contact) at the delivery location. If this time is exceeded, the order will be returned to our premises. A re-delivery fee of [€10 exc. VAT] will apply. Alternatively, the order may be collected from our premises during regular business hours.
- Any carriage and insurance costs incurred at your request must be reimbursed by you and are payable on the date you pay for the products.
- Delivery shall be made to your specified address at ground floor level only. It is the customer’s responsibility to ensure clear and adequate access is available at the time of delivery.
- Risk in the products passes to you upon delivery.
- By signing the delivery note or invoice, the recipient confirms acceptance of the delivery, including the product type and quantity as listed. Any discrepancies must be reported immediately at the time of delivery.
- You must inspect the products immediately upon delivery. Any visible damage, loss, or discrepancies must be reported and noted on the delivery documentation. Products found to be damaged on arrival must be reported within fourteen (14) days of receipt. Verified damaged on arrival products will be repaired, replaced, or refunded at our discretion.
- Claims for missing, incorrect, or damaged items will not be accepted after the delivery has been signed for, unless reported in writing within 24 hours of receipt.
- Any claim reported to us must be supported by proof that the damage occurred before receipt by you.
- For damage reported within 24 hours of delivery, we will either refund the price and carriage costs or replace the products at no additional charge.
- Delivery does not include installation, configuration, or setup of products unless this has been agreed upon in advance and quoted separately.
Your Right of Cancellation
- This right applies only if you are a “consumer”, meaning a natural person acting for purposes that are wholly or mainly outside your trade, business, craft, or profession. If you are purchasing as a business, including as a sole trader or on behalf of a company, this right does not apply. We reserve the right to request evidence of consumer status where necessary.
- You have a right to cancel the agreement at any time before the expiry of a period of 14 days beginning with the day after the day on which you receive the products.
- You may cancel the agreement by providing notice including the product, order reference, purchase date, delivery or collection date, client name, and address via: (i) Written notice delivered in person to: Newtech Limited, A4, Marsa Industrial Estate, Marsa, MRS3000, Malta; (ii) Written notice sent by post to the above address; or (iii) Email to the address provided above. Cancellation takes effect immediately upon receipt.
- Upon cancellation, you must: (i) Return the products to the address above, complete with any packaging, manuals, or accessories; damaged items may incur a charge; (ii) Cover the cost of returning the products; (iii) Take reasonable care of the products until they are returned, ensuring they are not damaged in transit; and (iv) Ensure the products are received in proper condition.
- If products are not returned as required, we may recover them directly, and you must reimburse the associated costs.
- Upon receiving the returned products, we will reimburse the cost of the products.
- We are not obliged to accept returns if: (i) The 14-day cancellation period has expired; (ii) Proof of purchase is missing; (iii) Any original packaging, seals, cables, accessories, or free gifts are missing, damaged or have been opened or unsealed; (iv) Products were used beyond what is necessary to assess their nature, characteristics, or function; (v) Products were specially ordered or customized; and/or (vi) Products were used or worn on the body (e.g., earphones, headphones).
Our Right of Cancellation
- We may cancel the agreement before delivery if: (i) Circumstances beyond our reasonable control arise; and/or (ii) Manufacturers or suppliers fail to provide the products.
- If we cancel, we will notify you promptly and refund any payments made using the original method of payment unless otherwise agreed.
- We are not liable for any loss or damage resulting from our cancellation, except for reimbursement of amounts paid.
Warranty
- The warranty coverage for all products shall be: (i) 2 years for consumers; and (ii) 1 year for legal persons including enterprises, corporate entities and other business organizations.
- The warranty period begins on the date you receive the product as evidenced by a valid original invoice or cash sale receipt.
- Warranty claims are valid only upon presentation of the original invoice or fiscal receipt. Where applicable, the product must be returned with any software and essential accessories required for inspection or repair.
- Manufacturer warranties and guarantees apply as outlined in official product documentation or websites.
- Manufacturer’s warranty covers only manufacturer defects and excludes issues caused by misuse, accidents, electrical damage, wear and tear, or external causes.
- Batteries, accessories, and consumables are subject to limited warranty terms as per manufacturer policy.
- Software supplied with the product, including operating systems, is provided “as is,” without guarantees of uninterrupted or error-free operation.
- All software supplied is subject to the applicable End-User License Agreement (EULA). You are responsible for complying with all licensing terms.
- We do not warrant software performance or compatibility and is not liable for bugs, incompatibility, or licensing breaches, unless otherwise agreed in writing.
- It is your responsibility to: (i) ensure the compatibility of the products we offer with your existing system components and any other products purchased from us; (ii) properly install our products within your existing system; and (iii) accessing the manufacturer’s website to download necessary product upgrades, including drivers and manuals, where applicable.
- Products returned for service or warranty must be clean, complete, and within the specified time frame. Products’ original packaging must also be kept in the best condition possible for the duration of the warranty.
- The warranty does not cover: (i) Defects or damage caused by misuse, negligence, improper handling, accidents, natural disasters, or exposure to liquids, fire, over/under voltages, and lightning; (ii) Damage resulting from unprofessional installation, repair, alteration, or modification; (iii) Consumable parts subject to wear and tear; (iv) Products with defaced, altered, or removed serial number labels; (v) Value or standard power supplies; (vi) Printers used with non-original cartridges or toners during the warranty period; (vii) Issues related to operating systems, software corruption, incorrect firmware upgrades, viruses, or malware.
- All products shall be inspected by our servicing team before any repairs or replacements are affected.
- It is your responsibility to back up all data and remove any sensitive information or personal data before service. We are not liable for data loss, software damage, or any associated consequences during repair.
- Repairs or replacements under warranty will involve comparable products or parts in compliance with local standards and manufacturer terms.
- Replacement products may be new or refurbished but will have functionality equal to the original product.
- Repair or replacement does not reset the warranty period but extends it by the duration of the service.
- Defective components replaced under warranty become our property.
- We may provide advice on installation, compatibility, configuration, and product upgrades with reasonable care. However, without knowledge of your specific application or existing system specifications, we cannot warrant suitability for a particular purpose.
- Compatibility with third-party hardware, accessories, or software is not guaranteed unless otherwise stated.
- Any advisory services, including installation or configuration support, are provided in good faith but non-binding unless covered under a written consultancy agreement.
Limitation of Liability
To the extent permitted by law we shall not be liable for any impossibility to use the product or for any direct, indirect, special, incidental, or consequential loss or damage to any person or property, whether arising from a breach of contract or negligence by us, our employees, or agents. Our liability for any breach of contract or negligence shall be limited to the original purchase price of the product(s).
Data Protection
In providing hardware and after-sales services, we may collect and process your personal information, including your name, contact details, billing and delivery information, and device details to fulfill our contractual obligations, provide support, and comply with legal requirements. We implement appropriate technical and organizational measures to protect your personal data and may share your it with manufacturers, suppliers, authorized service providers, or legal/regulatory bodies as necessary. Personal data is retained only for as long as necessary to fulfill the purposes outlined above or as required by law. You have the right to: (i) Access the personal data we hold about you; (ii) Request corrections to any inaccurate or incomplete data; (iii) Request deletion of your personal data, subject to our legal and contractual obligations; (iv) Object to or restrict certain types of data processing. Important Notice
Use all equipment on stable, well-ventilated surfaces and with appropriate power supplies. Disconnect power before maintenance. Keep devices away from liquids, contaminants, and hazards, and follow all provided safety and usage guidelines.
